What do business lawyers do about an ADR provision at the eleventh hour of contract drafting, just as the final agreement is being put to bed? They call a litigator with the cry, "You're an ADR practitioner. Help!" Life would be so much easier if business lawyers consulted litigators earlier. Why? Hear three litigators on the issues that confront contract drafters, what mistakes drafters can avoid by early consideration of an appropriate ADR provision, and what some sample clauses might look like, given adequate time to draft them.
