Since the passage of the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) in 2005, "means testing" is a concept, which is now at the core of consumer bankruptcy practice. This "test" to determine whether a debtor may file a Chapter 7 bankruptcy (liquidation) or whether the debtor is limited to a Chapter 13 filing (requiring a debt repayment plan) had lead to debate and confusion, as well as somewhat inconsistent bankruptcy court opinions, over exactly how the calculations are made in doing the "means test"!
