HITECH vastly expanded the complexity, range and scope of HIPAA privacy, security and enforcement and breach notification. In July 2010, the Secretary proposed amended HIPAA regulations and final regulations are expected soon. Our panel examines both parts of HIPAA as affected by HITECH and how the sum of the parts is challenging covered entities and business associates. They examine changed privacy standards, expanded applicability of security standards, the dramatic impact of direct regulation of business associates, changes in accounting obligations, and heightened enforcement. The panel also considers how covered entities and business associates are approaching business associate agreements knowing that these agreements are more important than ever.
