In recent years, lawyers have become more mobile. What was once an occasional occurrence--a lawyer`s departure from one law firm to join another--has become an every day event. This increased mobility has generated numerous legal and ethical issues and disputes. Compounding the situation, no neat framework exists to address the interests of the departing lawyer, the lawyer`s old firm, the lawyer`s new firm and, most importantly, the client.
In Joint Formal Opinion 2007-300, the Pennsylvania Bar Association`s Committee on Legal Ethics and Professional Responsibility and the Philadelphia Bar Association`s Professional Guidance Committee outlined important considerations for lawyers changing law firms, the firms they are leaving and the firms they are joining. Opinion 2007-300 and American Bar Association Formal Opinion 99-141 provide general guidance, but many attorneys and law firms believe more is necessary.
This program outlines the ethical, legal and practical issues these situations raise, and provides advice on how attorneys can address such matters while fully complying with their ethical obligations to the firms and their clients.
NOTE: ethics credits are "wild cards" and can be used to fulfill your general PA CLE requirement as well as your minimum 1 hour of ethics requirement.
