Courts in recent years have used four threshold legal doctrines to dismiss civil rights litigation and prevent litigants from having their cases decided on the merits: sufficiency of pleading, enforcement of federal laws enacted under Congress's Spending Clause power, immunity defenses and standing. Our panelists explain how each doctrine has been applied and discuss strategies to keep meritorious claims alive.
