Act 46 of July 6, 2010 which primarily amends the Pennsylvania Fiscal Code also grants automatic extensions to land use and building construction permits and approvals. This new development is extremely important to the practice areas of Municipal, Real Estate, Land Use, Environmental, and Construction law. Attorneys practicing in these areas need to understand that Act 46 could have a significant affect on construction and land development projects because it may alter the landscape between permittees and regulatory agencies by considerably extending approvals beyond established deadlines.
 
Municipal solicitors should be specifically aware that municipal staff may not be cognizant of the Act 46 Permit Extension. Therefore, they should ensure their clients are properly informed and trained.
