(Course materials pdated Dec. 06 with info Act 154 of 2006).
Two back-to-back sessions:
1--Policy and legislative initiatives over the past ten years have focused attention on land use patterns and the loss of open space. The conservation easement is a basic tool for preserving open space. Get a primer on conservation easements including an explanation of basic concepts, a discussion of the Pennsylvania Conservation and Preservation Easements Act of 2001, the basic considerations involved in the creation of a conservation easement and a brief discussion of political issues surrounding the employment of conservation easements.
2--Explore the factors which often drive the decision to ease property with conservation restrictions: the tax treatment associated with the grant or acquisition of conservation easements. Examine specific language of conservation easements and touch on common problems associated with conservation easements.
Recorded April 1 2004 at the annual Environmental Law Forum, a joint project of PBI and the Environmental, Natural Resources, and Mineral Law Section of the Pennsylvania Bar Association.
