Our instructor discusses the benefits of mediation and arbitration of oil and gas lease disputes, and explains the different types of mediation employed in this area. He offers tips on drafting an effective mediation or arbitration clause. Finally, using a hypothetical example, he examines some ethical considerations related to conflicts of interest, obtaining informed consent, and the perils of a lawyer doing business with a client.
