Our instructors begin with an overview of concepts relating to the attorney/client privilege, work product immunity, waiver of privilege, and waiver exceptions involving the common interest doctrine and joint defense agreements. They then emphasize the intersection of these concepts with opinion practice in both patent and trademark contexts. Hypothetical fact patterns reveal "best practice" recommendations for the IP practitioner to consider.
