This is a BASIC level course, intended for those who occasionally handle automobile accident cases and those who are new to the practice area. It will provide a primer on understanding uninsured (UM) and underinsured (UIM) motorist coverage in insurance policies and help you to identify whether you are taking a case that has the potential for a significant recovery…or not.
UM/UIM coverage is a key aspect of automobile insurance coverage. If the plaintiff you represent has suffered injuries, and the tortfeasor responsible has no insurance or only the minimum insurance coverages, chances are you are going to need to figure out whether and what UM/UIM coverage is available to your client. Many questions arise when dealing with UM/UIM issues, including:
Under what policies could my client turn for UM/UIM coverage?;
How do I settle with the tortfeasor for the limits of his policy without jeopardizing my UIM claim?
What sort of "offsets" apply to the UM/UIM coverages?;
What is the order of policy coverages and what do I need to know about subrogation?;
What types of damages are covered by UM/UIM coverage?
If I need to arbitrate the UM/UIM claim against my client’s own carrier – what should I know?
