The Supreme Court’s docket only rarely touches upon matters relating to real estate or development law. Last term was an exception. An enormous amount of public attention has been focused on the Kelo takings decision. However, the Supreme Court issued three other decisions with more significant legal impact: <EM>San Remo Hotels v. City and County of San Francisco</EM>, <EM>Lingle v. Chevron USA, Inc.</EM>, and <EM>Grable & Sons Metal Products, Inc. v. Darue Engineering & Manufacturing</EM>. This talk will focus on the latter three cases and the areas they cover: takings, rent and price controls, and federal jurisdiction over real-estate related lawsuits. It will also address the real estate and permitting issue most likely to reach the Supreme Court in the near future: “class of one” equal protection claims.
