This three hour course and panel discussion, presented by the Title Standards Committee of the Real Property Law Section, will address key topics in real estate law, new statutes and case law that affect the conveyancing practice of the NH real estate attorney. Issues will include power of attorney/attorney in fact and breach of fiduciary duties; condominium liens; clean energy districts, municipal tax deeds; problematic mortgage assignments and mortgage discharges; lost original documents and an update on the S.A.F.E. Act.
The practical use of existing Title Examination Standards will be addressed by the panel of experienced real estate attorneys will address the purpose of the title standards, the development process for new standards and the application of the title standards to resolving selected real estate issues. The panel discussion of title standards is designed for all attorneys whose practices involve real estate as well as other matters affecting real estate interests such as family law, corporate law or elder law. Attorneys who search directly or rely on another’s search as well as review titles will benefit from the presentation of the topics and standards whether new admittees to the Bar or seasoned real estate conveyancers.
