Sexual harassment continues to invade the work place, and is no longer limited to unwelcome flirting, inappropriate touching and crass language. Now that employees' work and personal time can be blended by the use of smart phones and tablet computers, issues such as "sexting” and social media use, even during off hours, can trigger sexual harassment complaints. Employers must engage in preventative measures, enact clear policies that address modern technology, train managers and employees, and conduct prompt investigations when complaints are received. Litigating these cases is always expensive, exacts an emotional toll on all involved, and reduces workplace productivity and collegiality. Attendees will learn litigation-prevention strategies for employers and hear the newest developments in this area of the law from both plaintiff and defense counsel. Use of employment practices experts will be explored, and a comprehensive case law update for practitioners will be provided.
