Summary:
The automatic stay of Section 362 can be described as the cornerstone upon which all of bankruptcy relief depends. Even so, Section 362 can only apply if there is a bankruptcy case initiated by an eligible debtor and a bankruptcy estate created by such a case. Thus, even the “cornerstone” of Section 362 requires a foundation. This presentation discusses new exceptions and termination under BAPCPA, motions for relief, impact on domestic cases and mechanic’s liens.
