Summary:

 

Equitable subrogation has long been a part of the jurisprudence of the State of North Carolina. A recent decision by the North Carolina Court of Appeals has cast some doubt on the viability and scope of the doctrine. This presentation will explore the history and purposes of equitable subrogation and various arguments for and against its application in particular situations.
