In October 2005 Congress added three provisions relating to the automatic stay in repeat bankruptcy filings. These changes are applicable to single or joint cases filed by (or against) individuals under all chapters of the Bankruptcy Code except Chapter 12. The changes will lead to motion practice most often in Chapter 13 cases, where repeat filers are more common given the debtor's largely unrestricted ability to dismiss voluntarily pursuant to 11 U.S.C. §1307(b). Counsel for prospective debtors who have had prior cases should review statues carefully, since a debtor may have to act swiftly to preserve the automatic stay or to obtain a stay. Join Hon.
