The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, Pub.L.No. 109-8, 119 Stat. 23 targets attorneys representing consumer debtors with various new provisions relating to enhanced certification and sanctions provisions in Chapt. 7 cases, regulation of attorneys as "debt relief agencies," and increased certification requirements for reaffirmation agreements. Much more active involvement in the reaffirmation process by the debtor's attorny is required. Simply receiving a partially executed reaffirmation agreement from the debtor, signing it, and passing it along to the creditor will not suffice.
