    Two nationally recognized speakers, including one of the primary drafters of the Stark II, Phase III Final Rule, will provide a complete review of the Stark Physician Self-Referral Rules in this 4 hour session.  Beginning with the basics and a history of Stark, the speakers will quickly move to an advanced discussion of the Stark II, Phase III rules and currently proposed changes to the rules.  The speakers will also discuss recent regulatory activity with respect to the anti-markup rules and how those provisions intersect with the physician self-referral rules.  The program will include hypotheticals to promote an understanding of the proper application of the law in context.  Our speakers will also provide an update on the status of the recently proposed changes which are expected to significantly impact current and future health care transactions. 

     

    Discussion will include:

    Ø      Fundamentals of the Physician Self-Referral Law including: an Overview of Statutory and Regulatory Provisions Rulemaking History of the Implementing Regulations, Differentiating Stark Law from Anti-kickback Issues.

    Ø      2007 Changes to the Physician Self-Referral Regulations including:

    ·        Stark II, Phase III

    ·        2008 Proposed Physician Fee Schedule

    ·        Anti-Markup Rules

    ·        Frequently Asked Questions

    ·        Summary of Advisory Opinions

    Ø      Recent Stark Proposals

    Ø      Discussion of Anticipated Changes in 2008 and the Impact of Recent and Proposed Changes to the Rules on Provider Relationships.

     

    New rules are expected to be released on April 15 will be discussed if available.
