Attorneys have a duty of loyalty to their clients. They advocate their clients' interests and protect their confidences. Environmental laws often require testing and public reporting by companies and individuals of their compliance with legal standards to protect the public health and welfare. Can environmental consultants' reports be kept confidential as work-product? Is an attorney or environmental consultant required, or even allowed, to disclose a potential public health risk that the client refuses to disclose? Can a consultant or attorney be sued as a co-conspirator with a client for allegedly misleading the public about the risk of environmental contamination? What must an attorney for a company do when an investigation shows a potential civil or criminal liability for the company, for which employees may face individual liability?
