This program will examine client communications and how to handle fee disputes. The panelists will discuss the requirements of client communication under the current Rule 1.4 of the Hawaii Rules of Professional Conduct and under proposed changes to the rules. Also to be discussed are the rules relating to client fess under Rule 1.5, the common problems lawyers run into relating to fees, and how fee disputes can be resolved with help from the HSBA program for the resolution of fee related disputes. The panelists will demonstrate how attorney-client agreement provisions and fee dispute resolution methods can impact legal errors and omission insurance. Judge Browning will provide judicial perspective, experience and insight into fee disputes, and Ms. Blossom Tong of Marsh Global Consumer will cover the relation and effect of fee disputes on attorneys' errors and omissions insurance.
