Ignorance is not bliss. In recent years, bed bug infestation and its threat to hotel guests have become a serious problem for hoteliers. Injuries, sometimes serious, have resulted in the proliferation of lawsuits against hotel owners. Eradicating infestation can be costly and ineffective if not properly implemented. Most bed bug lawsuits result from a hotel’s response to a claim. Counseling clients and defending legal claims necessitates a practitioner’s understanding of the technical complexity and multi-faceted legal issues, including tort and negligence claims, direct and third party contractual protections and obligations, and insurance coverage and claims. The panel will discuss the myths and realities of bed bug management and litigation, examining specific cases, court analyses, and practical strategies, third party claims against pest operators and/or manufacturers, and "best practices" for a hotel - discussing do`s and don`ts for responding to guest complaints.
