About This Seminar
Jury Selection, Opening Statement and Final Argument are the only times the claimant lawyer and the defense lawyer may stand before the jury and have the center of attention for a largely uninterrupted time period.
Although these episodes are prepared and although the jury may get to 'know' the lawyers better by watching them at other pressurized times during the trial, these performances are the most concentrated examples of the skill and advocacy sophistication of the lawyers and the true test of the advocates in-depth knowledge of the case and of opportunities used and not used to cast the case in the most persuasive light.
The difference between jury selection, opening statement and final argument, in the hands of a detailed quality-oriented trial lawyer, who is not satisfied with just "getting by adequately," and the performance in these areas of trial practice by a lawyer who approaches these tasks rather casually can often be dramatic. The facts of any given case are what they are. The advocacy, imagination and thoughtfulness applied to those facts is the mark of a master craftsman and trial lawyer.
The purpose of our remarks is to help and improve our approach and organization of these performances and to illustrate the universe of detail which awaits those who chose the path of better advocacy. Through exposure to new techniques we all can choose to grow.
