Ethical Issues You Cannot AvoidBack to top
"Though I've practiced about 39 years, this was first time I'd heard Milton Moss speak on ethics. He really "knows his stuff" right off the top of his head, and he has a great ability to give real life examples for each ethical dilemma and solution. I had one thought on his point about lawyer-as-witness: of course I agree with his conclusions as to what is ALLOWED under the rules, but do not overlook the PRACTICAL problem which may actually cause his client a problem and diminish the quality of the service rendered: if the lawyer and his firm do elect to stay in the case where the lawyer testifies, that "hands" the opposing side the argument which they often will make to the jury, in some fashion, that the lawyer, as agent of the party client, made a mistake and is doing CYA." J Michael (Birmingham, Alabama)
