TIMOTHY BERG practices primarily in the area of civil appeals and public utilities regulation. He is the chairman of Fennemore Craig's Appellate Practice Group. Mr. Berg regularly appears in proceedings before the Arizona Corporation Commission relating to the regulation of public service corporations, particularly with respect to regulation of telecommunications corporations. Mr. Berg has participated in the briefing or argument of over two hundred appeals before the United States Courts of Appeals for the Ninth Circuit, the Second Circuit, the Fourth Circuit, The Fifth Circuit, The Eleventh Circuit and the Federal Circuit, the Supreme Court of Arizona and both divisions of the Arizona Court of Appeals. His appellate practice has spanned a broad field of substantive areas including medical malpractice, product liability, environmental law, water law, state and local taxation, products liability, business torts, real property and mineral rights, bankruptcy, public utilities law, and employment law.
Mr. Berg received his B.A. with high distinction, (1972) from Arizona State University, and his J.D. with highest distinction, Order of the Coif, (1975) from the University of Arizona. He served as a law clerk to the Honorable Richard H. Chambers, Chief Judge of the United States Court of Appeals for the Ninth Circuit. He was an associate editor of the Arizona Law Review, and is a member of the Board of Directors of the Arizona Law College Association. In 1993, Mr. Berg was appointed by the governor to serve on the Arizona Commission on Uniform State Laws. He has served as a judge pro tem for Division One of the Arizona Court of Appeals. In 1994, Mr. Berg was elected to membership in the American Academy of Appellate Lawyers. He is a member of the Appellate Handbook Committee for the State Bar of Arizona and authored a chapter of that book. He has lectured on the subjects of Attorneys' Fees on Appeal, Ethics For the Appellate Lawyer, Appellate Procedure, Writing Briefs and Arguing Cases on Appeal. He is also a member of the Maricopa County Bar Association, the American Bar Association, and is a member of the Board of Trustees of the Maricopa County Bar Foundation.
